EVOLVE TENNIS ACADEMY T&C's

WARNING: This is a legal document that affects your rights, if you are uncertain or uncomfortable with some of the conditions of registration then we recommend that you obtain advice to ensure you understand and accept the conditions of entry.

I agree that I/my child/enrolled member can participate in these services and event on the following basis:

• I understand that I/my child/children should not participate in this event/events unless I am/he or she is/they are in a fit state to complete the event safely. I acknowledge that if I am aware of an existing medical condition and/or uncertain of my/his/her/their state of fitness then a medical practitioner should be consulted prior to participating.

• I consent to receiving any medical treatment including ambulance transportation in circumstances where a coach determines as a result of a health incident during or after the service provided or event.

• I have disclosed, provided or attached to my enrolment details of any medical or physical condition from which I suffer that might affect my performance or be relevant if medical treatment is needed, including any allergies or injuries.  I have supplied an emergency contact name and number. This person is contactable both during and after the event and is not another participant

• Evolve Tennis is not liable for any lost personal possessions.

• Although Safety precautions are undertaken by coaches and organizers (such as cones, first aid, staff training, safety instructions are a service to me and other participants) it is a requirement that participants need to act responsibly and sensibly in events and any other service

• My service registration is not transferable to any other person or other event/service.  Any attempt to transfer my entry or allow another person to participate under my name may result in cancellation without refund, insurance being deemed void and inability to enter further services or events.

• You, your child/children are insured with Public Liability, Products Liability, property damage and Professional Indemnity under Tennis Australia underwriter Sportcover Australia Pty Ltd. I understand that insurance cover in our coaching services may not cover me for all injury, loss or damage sustained by me.
  
  Your coach:
  (a) Is insured by Sportscover
  (b) All adult coaches have a Valid NSW working with Children Check form

• Add my email address to Evolve Tennis e-marketing and postal information, promotions and newsletters. You can cancel and unsubscribe at any time. Email address and contact details will not be given to any third party, used for spam or commercial purposes.

• Give permission for me/my child/children when registered in our coaching services, camp or competitions to participate or be involved in: (a) shuttle bus transportation when purchased and where needed, Inter club challenges, all affiliated excursions at tennis camps throughout term coaching, (e) sport classes, private lessons or special events.

• Accept Membership to Evolve Tennis, Roseville Park Tennis Centre and, Northern Suburbs Tennis Association, Tennis New South Wales and Tennis Australia.

• Competition: Abide by Northern Suburbs Tennis Association and Tennis Australia competition rules, etiquette, terms and conditions.

• Accept rewards such as prizes, ice blocks, sweets, lollies, toys, soft drinks or chips. In circumstances where there maybe allergy issues with food you will inform Evolve Tennis

• By participating, I accept all risks necessarily flowing from my participation that could result in injury. Accordingly, I release all persons or corporations associated directly or indirectly with the conduct of the event from all claims demands and proceedings arising out of my participation and I hereby indemnify them against, all liability (including liability for their negligence and negligence of others) for all injury, loss or damage arising out of or connected with my participation in this event.  This release shall extend to and include Evolve Tennis, Roseville Park Tennis Centre, Northern Suburbs Tennis Association, Tennis New South Wales and Tennis Australia, event organizers and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers including event medical and paramedical personnel. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.

• You warrant that:
  (a) all personal details provided are true and accurate;
  (b) you have all necessary rights as a student, parent or guardian to grant the rights;
  (c) Information is not obscene or defamatory;
  (d) You will indemnify Evolve Tennis against any loss or damage resulting from any breach of these warranties.
  (e) You acknowledge that Evolve Tennis is under no obligation to exercise any of the rights
  (f) I certify that I am a student/parent/legal guardian and I have read this document and understand and accept the terms and conditions it contains.

• Lesson Makeups/Cancellations/Transfers:

• (a) Lindfield East Public School CW (Creative Workshop) No makeup lessons because Lessons are on rain, hail or shine. Theory sessions are conducted in the library. Transfer to another class/day/time during the term period is permitted subject to availability.
  
  (b) All Pee Wee, Hotshots & Junior Squads will run Rain Hail or Shine. Theory &/or fitness will be conducted in the Clubhouse. 
  In the event of wet weather where courts are unplayable – ALL Pee Wee, Hotshots & Junior Squads are entitled to 1(ONE) make-up per term (this includes sick/away days).
  This make-up is to be arranged with your Coach conducting the lesson. If you are unable to do a make-up on a different day of the week, you may also do a full morning at Camp during the school holidays (which once again must be confirmed with your coach). 
  There will strictly be no refunds or roll-over of credit to a following term. 
  
  (c) In the event of wet weather, all Adult classes are strictly 2(TWO) make-ups per term, which must be organised directly with your coach. There will be strictly no refunds or roll-over of credit to a following term. 
   

• (d) Private lessons (inc semi, tri, quad, casual and termly): Fees include 10 sessions per term inclusive of court hire. During rain or cancellations a makeup lesson will be given. Cancellations must be made within 2 hours of lesson time otherwise full price will be paid and no makeup will be given. A permanent private booking/term booking allows strictly two makeup lessons. e.g. if you cancel three lessons, the third lesson will not given as a makeup or be refunded. Makeups will be allowed during the term or the upcoming holiday period only. These are Non-transferable to the following term. 

• Extended cancellations of private sessions may end in default of your time slot as these are in extremely high demand. 

• (e) School Sport/PSSA Sport: On rainy days if you are away or cancel no makeup lesson will be given. For LEPS PSSA Sport Theory is conducted in the library. Full price will be paid with no refund

Shuttle Bus Service Monday to Friday during the term

This must be booked on our website or via email. If child is away/not catching bus we must be notified at roseville@evolvetennisacademy.com or 02 9971 0644. Failure to contact us once, you will be warned. Twice, your child will be removed from the free bus service. This bus service will operate rain hail and shine.

Supervision is until 530pm Monday to Friday during the term

This must be booked on our website or via email. If your child is away or does not need this free service we must be notified at

roseville@evolvetennisacademy.com or 02 9971 0644. Failure to contact us once, you will be warned. Twice, your child will be removed from the free service.

Any inappropriate and/or unlawful behaviour such as damage/vandalism of our property or vehicles, abusive or offensive behaviour including but not limited to sexist and/or racist and/or bullying and/or inappropriate behaviour will result in immediate cancellation of membership. Fees will not be refunded. Any repairs, clean up costs will be charged and will be the liability of you, the parent or guardian.
